In Illinois, lessors of residential property containing 5 or more units are governed by the Security Deposit Return Act (765 ILCS 710).
The 30-Day and 45-Day Two-Tier Deadlines
- 30-Day Itemization: Within 30 days of surrender, the landlord must furnish an itemized statement of damage allegedly caused, including estimated repair costs.
- Paid Receipts Due within 30 Days: The landlord must attach paid receipts to the statement, or deliver them within 30 days after the initial estimate is furnished.
- 45-Day Full Return: If no damages are claimed, the full deposit must be returned within 45 days.
Double Damages for Bad Faith
Under 765 ILCS 710/1(a), if a landlord fails to comply with the itemization and receipt requirements, or withholds funds in bad faith, the tenant is entitled to recover twice the amount of the deposit plus court costs and reasonable attorney's fees.
