Washington State Security Deposit Law: RCW 59.18.280 30-Day Rule

Washington state amended its Residential Landlord-Tenant Act to expand tenant protections under RCW 59.18.280.

The 30-Day Accounting Deadline

Effective 2023, Washington extended the landlord return timeframe from 21 to 30 calendar days. The landlord must deliver a full refund or a full and specific statement of the basis for retaining any portion of the deposit, accompanied by documentation such as repair invoices.

The Absolute Move-In Checklist Prerequisite

Under RCW 59.18.260, a landlord cannot collect or retain ANY security deposit unless a written move-in condition checklist was signed by both parties at the start of the tenancy. If no signed checklist exists, the landlord forfeits all rights to withhold deposit funds.

Double Damages Discretion

Under RCW 59.18.280(2), a landlord who intentionally refuses to deliver the statement and deposit within 30 days may be liable for up to double the amount of the deposit, plus court costs and reasonable attorney's fees.
